This website is operated by Collections By Biiibo. Throughout the site, the terms “we”, “us” and “our” refer to Collections By Biiibo. Collections By Biiibo offers this website, including all information, tools and Services available from this site to you, the user, conditioned upon your acceptance of all terms, conditions, policies and notices stated here.

By visiting our site and/ or purchasing something from us, you engage in our “Service” and agree to be bound by the following terms and conditions (“Terms of Service”, “Terms”), including those additional terms and conditions and policies referenced herein and/or available by hyperlink. These Terms of Service apply to all users of the site, including without limitation users who are browsers, vendors, customers, merchants, and/ or contributors of content.

We reserve the right to update, change or replace any part of these Terms of Service by posting updates and/or changes to our website. Our store is hosted on Shopify Inc. They provide us with the online e-commerce platform that allows us to sell our products and Services to you.

SECTION 1 - ONLINE STORE TERMS
By agreeing to these Terms of Service, you represent that you are at least the age of majority in your state or province of residence, or that you are the age of majority in your state or province of residence and you have given us your consent to allow any of your minor dependents to use this site.
You may not use our products for any illegal or unauthorized purpose nor may you, in the use of the Service, violate any laws in your jurisdiction (including but not limited to copyright laws).
You must not transmit any worms or viruses or any code of a destructive nature.
A breach or violation of any of the Terms will result in an immediate termination of your Services.

SECTION 2 - GENERAL CONDITIONS
We reserve the right to refuse Service to anyone for any reason at any time.
You understand that your content (not including credit card information), may be transferred unencrypted and involve (a) transmissions over various networks; and (b) changes to conform and adapt to technical requirements of connecting networks or devices. Credit card information is always encrypted during transfer over networks.
You agree not to reproduce, duplicate, copy, sell, resell or exploit any portion of the Service, use of the Service, or access to the Service or any contact on the website through which the Service is provided, without express written permission by us.
The headings used in this agreement are included for convenience only and will not limit or otherwise affect these Terms.

SECTION 3 - ACCURACY, COMPLETENESS AND TIMELINESS OF INFORMATION
We are not responsible if information made available on this site is not accurate, complete or current. The material on this site is provided for general information only and should not be relied upon or used as the sole basis for making decisions without consulting primary, more accurate, more complete or more timely sources of information. Any reliance on the material on this site is at your own risk.
This site may contain certain historical information. Historical information, necessarily, is not current and is provided for your reference only. We reserve the right to modify the contents of this site at any time, but we have no obligation to update any information on our site. Prices for our products are subject to change without notice.
We reserve the right at any time to modify or discontinue the Service (or any part or content thereof) without notice at any time.
We shall not be liable to you or to any third-party for any modification, price change, suspension or discontinuance of the Service.

SECTION 5 - Your Conduct

    • In using the Services you shall not:

      1. copy or distribute any part of the App or Site (including any content) without our prior consent; alter or modify any part of the App or the Site;
      2. upload, post, email, transmit or otherwise make available on the App:
        • any material that is unlawful, harmful, threatening, abusive, harassing, tortuous, defamatory, vulgar, obscene, pornographic, libelous, invasive of another's privacy, hateful, or racially or ethnically objectionable, encourages criminal behavior, gives rise to civil liability, violates any law, or is otherwise objectionable
        • any falsehoods or misrepresentations or create an impression that you know is incorrect, misleading, or deceptive, or any material that could damage or harm other users in any way;
        • any unsolicited or unauthorized advertising, solicitations for business, promotional materials, "junk mail," "spam," "chain letters," "pyramid schemes," or any other form of solicitation;
        • any material that contains software viruses or any other computer code, files or programs designed to interrupt, destroy or limit the functionality of any computer software or hardware or telecommunications equipment or data or the App or that of any users or viewers of the App or that compromises a user's privacy;
      3. impersonate any person or entity or misrepresent their affiliation with a person or entity;
      4. interfere with or disrupt the Site or App, or disobey any requirements, procedures, policies or regulations of networks connected to the Site or App or probe, scan, or test the vulnerability of any system or network or breach or circumvent any security or authentication measures;
      5. collect or store personal information about other users of the Services; or
      6. resell the content of the Site or App, the use of the Site or App, access to the Site or App or the content therein.
SECTION 6 - Registering​ ​as​ ​a​ ​Customer

  1. In order to use BIIIBO’s Services, you must register as a customer by providing your legal first name and last name, your legal business name, your industry, your email address and phone number. You must be at least 18 years old to register for the Services and have a valid credit card. By signing up to create an account with us, you represent and warrant that you have the right to engage the Service for the location that you list for receipt of the the materials delivered by us.

    Any personal information provided by you to us will be stored in accordance with our Privacy Policy. We recommend that all customers carefully read our Privacy Policy. You must keep your user login details and access to the App secure. We will not be liable for any damages caused by virtue of the compromise of your account or password, including any unauthorized access to your account, use of your password or compromise of your credit card details. Please contact us immediately if you suspect or become aware of any unauthorized use of your username or password or any other breach of security.

SECTION 7 - Custom​ ​Orders

  1. The APP enables users to make custom orders for items that are not in stock or that exceed the maximum limits set out in the APP for regular orders. When placing a custom order, the CLIENT must provide any relevant information Biiibo requires to complete the quote and order. Once the order has been received the order will be shipped out via prior agreed upon services. The CLIENT will receive a custom order invoice by e-mail at the e-mail address registered on the account. Invoice​ ​must​ ​be paid​ ​in​ ​full​ ​before​ ​the​ ​order​ ​is​ ​processed.

SECTION 8 - Sale of Goods
    • All sales marked as "final" anywhere on the product page or during checkout cannot be returned or refunded. 
SECTION 9 - Shipping & Returns
    • Biiibo is not responsible for and cannot be held liable for any missing or damaged items during 3rd party transit. 
    • Returns must first be approved by Biiibo. CLIENTS must contact Biiibo through our tolll free number +1 844-841-4443 or our website form (contact us page).
    • Returns must be shipped back to Biiibo at the CLIENTS expense.
    • A 20% restocking fee will apply to all returned products. 

    • CLIENTS must ensure that the product(s) marked for return are:

      1. BIIIBO reserves the right to process returned material in as efficient a timeline as possible.  All claims for damages or shortage must be made by the CLIENTS within 1 business day of receipt of material.
      2. In as-new condition as it was originally delivered by BIIIBO
      3. Shipped back to Biiibo
      4. In the event that during inspection the returned material is found not to be in as-new condition as it was originally delivered, BIIIBO will not refund the CLIENTS for the material and will charge the CLIENTS an additional 20% disposal fee.

      CLIENTS must note that items and categories listed below, but not limited to, are considered final sale and are not eligible for return:

      • All custom ordered (not in stock) items
      • Products marked as "Final Sale", "Clearance", and "Sale" 

      It is the CLIENTS’ responsibility to check with BIIIBO’s customer support team to make sure that item is eligible for return.

SECTION 10 - Payments​ ​for​ ​Services​ ​and​ ​Materials​ ​Ordered
    • Payment for the Services must be made through THE APP using our selected third party processor. You agree that you will not offer to or make any payments outside of the functionality of THE APP. You represent and warrant that any credit card, payment and billing information you provide is complete and accurate and that you are authorized to use the credit card(s) you are using. When you complete your order on THE APP, a pre-authorization will be taken from your credit card. After purchasing the requested materials, BIIIBO will charge the credit card the full amount including the real cost of materials and delivery fees.
SECTION 11 - Disputes​ ​and​ ​Complaints 
    • If you are dissatisfied with the Services provided by BIIIBO, you may lodge a formal complaint with us by contacting us through THE APP or our toll free number 1 844-841-4443. We will work hard to resolve any disputes that may arise through the use of the BIIIBO service in an amicable and professional way. We will provide an outcome which will be agreed upon by all parties involved within 14 business days of the original complaint when possible. If the dispute cannot be resolved then BIIIBO will use any reasonable means to attempt to resolve the dispute.
SECTION 12 - Copyright​ ​and​ ​Trademark​

    • ​Information about Services, PRODUCTS and Business Processes are the property of BIIIBO Inc. and its licensors, and are protected from unauthorized copying and dissemination by copyright law, trademark law international conventions and other intellectual property laws. All of our logos and branded content are trademarks or registered trademarks. Nothing contained on THE APP or THE SITE should be construed as granting, by implication, estoppel, or otherwise, any right to use THE SITE, THE APP or THE SERVICES or any materials displayed therein, through the use of framing or otherwise, except:

      • as expressly permitted by these terms and conditions; or
      • with the prior written permission of us. You shall not attempt to override or circumvent any of the usage rules or restrictions on the App or within the Services.
